GRAS!!!!!!
(Under Specific Conditions)

The attached document, "DOH GRAS Determination for Awa," provides a detailed analysis of the traditional beverage made from 'Awa (Kava, Piper methysticum) and its recognition as Generally Recognized as Safe (GRAS) under specific conditions. The Department of Health document discusses the plant's characteristics, historical use in Hawaii, and traditional preparation methods. It references various historical and scientific sources to demonstrate the long-standing consumption of 'Awa in Hawaii. The determination is based on the common use of the noble variety of 'Awa (Kava) root mixed with water or coconut water, prepared through aqueous extraction, aligning with the criteria of 21 CFR §170.30(c)(1). The document emphasizes that this traditional preparation method must comply with federal and state food safety laws to be considered GRAS. Furthermore, they distinguish between 'Awa (Kava) as a dietary supplement and its use as a traditional beverage, with different regulatory implications for each.

GRAS!!!!!!
(Under Specific Conditions)

This is very telling (from Attachment A): "As previously mentioned, the FDA is incorrectly utilizing the term “kava” to conflate extracts with a food product, which needs to be corrected. They cannot launch a review on particular subject and conclude on another one." That last sentence describes the original FDA modus operandi, they had proposed to study traditionally consumed kava, but ended up issuing warnings about extracts. They pulled the infamous 'bait and switch' technique in their conclusions on kava.
